JUSTICIA Network Joint Briefing on the Directive on Right of Access to a Lawyer and to Communicate Upon Arrest April 2013

This joint briefing was submitted to the trilogue discussions between the Council of the European Union, European Parliament and European Commission in April 2013. This text welcomes the positive developments on a number of contentious points but raises five remaining concerns, i.e. minor offences, derogations, confidentiality, dual representation in European Arrest Warrant cases and remedies, which we believe deserve special attention from the co-legislators at this critical juncture in the negotiations, to ensure the Directive does not undermine human rights standards.
